AGREEMENT TO INVESTIGATE COMPRESSED WORK WEEK

It is agreed that the Company and UPIU Local 608 and 712 will jointly investigate the utilization of a compressed work week schedule or alternative schedules for use at the Consumer Products Division and/or Idaho Pulp and Paper Division.

If joint investigation determines such schedule(s) to be reasonable and practical, neither the Company nor the Union may unilaterally implement a compressed work week schedule without an addendum vote by members of the local unions 608 and 712. The addendum must pass by a 50% + 1 majority of the eligible bargaining unit employees. There is no intent to change the meaning, interpretation or intent of the current labor agreement, except where necessary to accommodate the compressed work week schedule. These accommodations are defined in the compressed work week language.

It is understood that upon implementation of a compressed work week schedule:

           There will be no adverse effects on employee safety, morale, attendance or mill efficiency caused by the compressed work week.

There will be no decrease in quantity or quality of production caused by the compressed work week.

• Adequate qualified replacements will continue to be available for relief purposes when required per language contained in the compressed work week language.

           Qualified employees will continue to be available for work (i.e. wire and felt changes, lockout, etc.) when required with due consideration for safety and efficiency of operations.

           A trial period will last one year. At the end of one year the trial may be extended at that time. If eliminated it will continue at least until the completion of the appropriate shift cycle.

The Company and the Union agree to modify provisions of the labor agreement so that utilization of a compressed work week schedule will not result in additional cost to the company, nor will it adversely affect the employee.

The parties agree the terms and conditions of the existing labor

Either party (the Union Standing Committee or the Company) may, at any time, cancel the compressed work week. Upon such cancellation the Southern swing schedule will be resumed and all conditions of the Labor Agreement will apply. Prior to such cancellation the party calling for termination of the compressed work week schedule will notify the other party of the concerns causing such termination. The other party may offer such suggestions as appropriate to correct the concerns. If agreeable the party calling for termination of the compressed work week schedule may rescind their action.

It is understood by both parties that problems may arise during the trial period. Should. this occur, the parties will meet to discuss the problem--to--reach a satisfactory solution prior to filing grievances regarding aspects specific to the compressed work week schedule or language.

This agreement is subordinate to the Labor Agreement.


 

COMPRESSED WORK WEEK LANGUAGE

For the purpose of a compressed work week schedule, the parties hereby mutually agree to the following terms and conditions:

1.         The parties agree the terms and conditions of the existing Labor Agreement remain in full force and effect regardless of what work schedule is in effect at the mill. The compressed work week schedule and memoranda are to apply only to 7 day rotation tour workers. Either party (the Union Standing Committee or the Company) may, at any time, cancel the compressed work week. Upon such cancellation the Southern Swing schedule will be resumed and all conditions of the Labor Agreement will apply. Prior to such cancellation the party calling for termination of the compressed work week schedule will notify the other party of the concerns causing such termination. The other party may offer such suggestions as appropriate to correct the concerns. If agreeable the party calling for termination of the compressed work week schedule may rescind their action. If a bail out is exercised the 12 hour shift schedule would continue until the end of the cycle.

2.         Twelve (12) hour shift schedule will be permitted in those divisions which by a vote of 50% + 1 have approved a trial period. Supervisors that would work a 12 hour schedule will vote in the trial vote.

Following the trial period a approval vote of 2/3 majority or 67% is necessary for 12 hour shifts to be continued. The trial period will run from January 1, 1996 through the end of the last pay period in 1996.

3.         The twelve (12) hour shift times of 7:00 a.m. will define a day as period of twenty-four (24) hours beginning 7:00 a.m., and a week as a period of seven (7) calendar days beginning at 7:00 a.m. Monday. Definition of Day under Labor Agreement remains in effect.

 

It is clearly understood by both parties that qualified replacements must be available for relief purposes when required. Replacements will normally come from either callboard employees or employees on their scheduled days off. When overtime work is required, the Company will make reasonable effort to assign it to an employee(s) from the position or job classification in which the vacancy occurs by:

A.        Call in senior eligible person on their days off, that last held the position.

B.        Call in junior eligible person on their days off, that last held the position.

Note - Not eligible if would place in a situation of exceeding contractual maximum allowable work hours or rest requirements.

C. Refer to volunteer list by job classification by seniority of eligible employees in the line of progression.

D. Refer to volunteer list by seniority of eligible and qualified employees in the line of progression. Pay would be that of the job.

E.        If necessary an employee will be forced to cover the vacancy. The force order will be the order that employees were called in items a. through d_ above.

5.         Overtime at the rate of time and one-half will be paid for all work in excess of eight (8) hours in any one day at the compressed pay rate for hours worked on the compressed work week schedule. (Hours worked past 12 hours will be paid time and one-half at contract rate.)

6. Tour workers shall receive time and one-half pay at the compressed rate for time worked on Sunday_ Hours worked on a Sunday past twelve hours will be paid at time and one-half at contract rate of pay.

7.         Floating holidays will be paid at the straight time contract rate of the last job. Rate of the job referenced, is not the compressed rate. Floating holidays will be based on the total amount of accumulated hours as stated in the current Labor Agreement (40 hours). Employees will be permitted to take three (3) twelve hour days off and receive pay for the additional four (4) hours. The employee may also bank the extra four (4) hours over the next year (s) up to a maximum of twelve (12) hours banked. Floating holidays will be scheduled as they have been in the past.

8_        Jury duty allowance is provided, however, such reimbursement shall not exceed fourteen (14) hours a day at the compressed rate of pay or forty (40) hours per week at the contract rate.

9. Funeral leave is provided per current contract language. Reimbursement shall not exceed fourteen hours pay at the compressed rate per eligible days.

10. The job rates of the employees working the compressed work week schedule will be adjusted to .88235 of the rate established by the job analysis plan or contract rate. However, overtime pay for work outside regular compressed work

week schedule, call time, paper machine clothing time, allowance for failure to provide work, vacation pay and holiday pay will be paid at the statused rate of pay as defined in the Labor Agreement.

11. If an employee is called out prior to his or her regular starting time, he will be paid at the call out rate at time­and-one-half contract rate until the beginning of his regular shift. After eight (8) hours of continuous work, time-and­one-half at the compressed rate of pay will apply (as per #6). After twelve (12) continuous hours of work time-and-one-half at contract rate will apply.

12. Group term life insurance, AD&D, A&H, accident coverage and pension will be covered based on existing contract language.

13. Time worked on non-restricted holidays will be paid per current contract provisions using the compressed pay rate of .88235. Holidays required to be paid at double time will be paid at the normal contract rate.

14. Attached are the two different schedules for the compressed work week which will be voted on at the time of the trial vote.

15. No employee(s) scheduled for graveyard will be scheduled to attend mandatory meetings or off shift training sessions. If the schedule A (2 day, 2 night) schedule is adopted, the 24 hours in between days and nights will be discussed as a possible training period.

16.       Employees scheduled to attend meetings or training sessions on a day they would have worked a twelve hour compressed shift, will be allowed to return to their regular (day) scheduled twelve hour compressed shift after the meetings and training sessions in order for them to complete a twelve hour shift at the compressed rate of pay. Should the meeting or training session be outside of the regularly scheduled compressed shift hours the employee will be paid at time and one-half the contract rate. If an employee goes back to their shift, the person covering goes home.

17. One meal which shall be hot, if practical, shall be furnished at a usual meal time by and at the expense of the company to any employee when:

(1) is required to work more than 13.5 hours, or (current contract language)

18. Except as outlined above, the terms and conditions of the existing collective bargaining agreement remain unchanged.

POTLATCH CORPORATION CONSUMER PRODUCTS DIVISION

1.         PAY FOR MEETING PRINCIPLES:

I .         Meetings are productive work. They benefit the Mill, and therefore all employees.

2.         Meetings will be scheduled as far in advance as practical, but should be canceled or postponed if necessary.

3.         Increased costs and/or lost productivity and/or individual disruptions, due to meeting attendance, or to cover for meeting attendance, will be closely managed and minimized.

4.         Employees should be given the opportunity to not lose money (in terms of their scheduled earnings) as a result of meeting attendance.

5.         Employees need to communicate with their supervisor as far in advance as possible on plans to be off work to attend a meeting and their intention to return to work or not following the meeting (when applicable).

6.         In an effort to avoid disruption of the work schedule and afford employees the opportunity to attend meetings. Whenever possible, meetings will be scheduled in conjunction with the appropriate department start/stop time and last no longer than three hours.

II.          PAY FOR MEETING GUIDELINES (compressed WORK WEEK ONLY

The following guidelines are intended to provide consistency in paying employees who attend meetings on the compressed schedule in a way that minimizes the cost impact and inconveniences to the employee and the company.

Where possible, it is recommended that meetings be scheduled in the AM.( 7:00 a.m. to 10:00 a.m. ), and not last more than three hours. This will afford employees the opportunity to stay over and avoid disruption of the schedule.

When it is unavoidable to schedule AM. meetings or when longer duration meetings are necessary, the following guidelines should be followed:

After the meeting, the employee either goes home and is paid at contract rate or comes to their department and completes a 8-hour shift at contract rate paid at time and one-half. Whenever possible, schedule meeting in P.M. and employee works regular schedule on Day 4.
